1. Introduction
These Terms and Conditions ("Terms") govern your access to and use of lifestyle.houselevi.com and all travel and lifestyle services offered by House Levitika Plus Ltd, a company incorporated in Kenya ("Company", "we", "us"). By accessing our website or engaging our services, you agree to these Terms in full. These Terms are governed by the laws of the Republic of Kenya including the Tourism Act (Cap. 383), the Consumer Protection Act and the DPA 2019.
2. Eligibility
You must be at least 18 years of age to engage our services. By booking, you confirm you are 18 or older, or are booking on behalf of a minor as a parent/guardian.
3. Travel Enquiries and Bookings
- Submitting an enquiry does not constitute a confirmed booking. A booking is confirmed only upon receipt of a written booking confirmation from us and payment of the required deposit or full amount.
- All bookings are subject to availability at the time of confirmation.
- You are responsible for ensuring all traveller details (names, passport numbers, dates of birth) are accurate at the time of booking. Errors may result in additional charges from airlines or hotels.
4. Pricing and Payment
- All prices are quoted in Kenyan Shillings (KES) or US Dollars (USD) as indicated, and are subject to change until a booking is confirmed.
- A deposit of the amount specified in your quote is required to secure a booking. The remaining balance is due by the date specified in your booking confirmation.
- Prices include the services listed in the package description only. Airfare, visas, travel insurance, personal expenses and items not listed are excluded unless stated.
- We reserve the right to pass on price increases imposed by airlines, hotels or governments (e.g. fuel surcharges, taxes) prior to full payment.
5. Passports, Visas and Travel Documents
- You are solely responsible for obtaining valid travel documents including passports (valid for at least 6 months beyond your return date), visas, and any required vaccinations.
- We can provide guidance on visa requirements but do not guarantee accuracy as requirements can change. We are not liable for any loss arising from your failure to obtain necessary documents.
- Ensure your name on travel documents exactly matches the name used at booking.
6. Travel Insurance
We strongly recommend that all travellers purchase comprehensive travel insurance covering cancellation, medical expenses, evacuation, baggage loss and personal liability prior to travel. House Levitika Plus Ltd does not provide travel insurance. Failure to obtain travel insurance is entirely at your own risk.
7. Cancellations and Refunds
7.1 Cancellation by You
All cancellations must be submitted in writing to travel@houselevi.com. The following cancellation fees apply (calculated from the date we receive your written cancellation):
- More than 60 days before departure: Loss of deposit only.
- 30–59 days before departure: 50% of total booking value.
- 15–29 days before departure: 75% of total booking value.
- Less than 14 days before departure: 100% of total booking value (no refund).
Some components (e.g. international airfares, non-refundable hotel rates) may be subject to stricter cancellation policies imposed by third-party suppliers. These will be communicated at the time of booking.
7.2 Cancellation by Us
We reserve the right to cancel a booking due to circumstances beyond our control (Force Majeure — see clause 11), failure to reach minimum group size, or supplier failure. In such cases, we will offer a full refund of monies paid to us or, where possible, an alternative travel arrangement. We are not liable for consequential losses including airfares booked independently.
8. Changes to Bookings
- Requests to amend a confirmed booking must be made in writing and are subject to availability and any supplier amendment fees.
- We will endeavour to accommodate changes but cannot guarantee them.
- We reserve the right to make minor changes to itineraries where necessary (e.g. alternative accommodation of equivalent standard). We will notify you of any significant changes.
9. Health, Safety and Conduct
- You are responsible for ensuring you are physically and medically fit for your chosen travel experience.
- We reserve the right to exclude any traveller whose conduct is disruptive, endangers others, or is in breach of local laws, without refund.
- You must comply with the health and safety requirements of all suppliers, accommodation providers and transport operators.
- Any health requirements or restrictions relevant to your destination are your responsibility to investigate and comply with.
10. Liability
- House Levitika Plus Ltd acts as an agent for third-party service providers (airlines, hotels, tour operators). We are not liable for the acts or omissions of those third parties.
- Our liability for any claim arising from our own negligence is limited to the total amount paid to us for the relevant booking.
- We are not liable for any indirect, consequential or special losses including loss of enjoyment, loss of earnings or incidental expenses.
- Nothing in these Terms limits our liability for death or personal injury caused by our proven negligence.
11. Force Majeure
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, civil unrest, government actions, pandemics, natural disasters, strikes or supplier failure. In such circumstances, we will endeavour to minimise disruption and offer alternatives where possible.
12. Complaints
Any complaint must be raised with our team at the earliest opportunity during your travel so that we can attempt to resolve it. If unresolved, submit a formal complaint in writing to travel@houselevi.com within 28 days of your return date. We will respond within 21 days of receipt.
13. Intellectual Property
All content on this website — including text, photography, itinerary designs and editorial — is the property of House Levitika Plus Ltd and may not be reproduced without our express written consent.
14. Privacy
Your data is processed in accordance with our Privacy Policy and Cookie Policy, incorporated into these Terms by reference.
15. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be subject to good-faith negotiation, followed by mediation if unresolved, and ultimately to the exclusive jurisdiction of the courts of Nairobi, Kenya.
16. Severability and Entire Agreement
If any provision is found invalid or unenforceable, the remainder of these Terms continues in full force. These Terms, together with the Privacy Policy, Cookie Policy and Travel Disclaimer, constitute the entire agreement between you and House Levitika Plus Ltd for travel services.
